The following critical provisions of the Chapter 7 rules are summarized for your convenience.
Application
Trial Court Delay Reduction Act of 1986 (Section 68600, Government Code) later revised as the Chapter 7 Rules became effective January 1, 1994, and apply to all civil cases. California Rules of Court rule 212 imposes other substantial requirements for case management.
Priority Over Other Rules
Chapter 7 Rules shall have priority over all other Local Rules to the extent the others are inconsistent.
Challenge To Assigned Judge
If the case is under "direct assignment" (assigned to a judge for all purposes or for all further proceedings), a challenge under Code of Civil Procedure Section 170.6 must be made by a party within 15 days of the party's first appearance (Rule 7.5). If the case is assigned under a "Master Calendar" system (not assigned to a judge until time of trial), then the challenge must be made no
later than the time the case is assigned for trial. In all other cases, the time to file a challenge under Code of Civil Procedure 170.6 starts running upon notice of the case assignment to the judicial officer. For further information, refer to the code referenced above.
Time Standards
Cases assigned to the Individual Calendaring Court will be subject to processing under the following time standards:
Complaints
Proof of Service of all complaints shall be filed within 60 days of filing the complaint. Each defendant must be served with the complaint and the alternate dispute resolution (ADR) packet.
On amended complaints, the added defendant must be served and a proof of service must be filed within 30 days of filing of the amended complaint.
Cross Complaints
Unless leave of court is first obtained, no cross-complaint may be filed by any party after their answer is filed. Proof of Service of cross-complaints shall be filed within 30 days of the filing date.
Except for cases exempt under CRC 212(a), in all unlimited civil cases, the case management conference shall be held not later than 180 days after the complaint is filed. In limited civil cases, the court will conduct a case management review instead and, unless otherwise ordered by the court, the parties do not need to appear. This rule does not apply to family law, probate, juvenile court, small claims, unlawful detainer, and civil petition cases.
Unless otherwise ordered by the court, no later than 30 calendar days before the date set for the case management conference or review, the parties shall meet and confer, in person or by telephone, to consider each of the issues identified in CRC 212(e) and (f). No later than 15 calendar days before the date set for the case management conference or review, each party must file a case management statement using Judicial Council Form CM-110, and serve it on all parties in the case (CRC 212(g)).
At the case management conference, all parties or their counsel must appear and be fully prepared to discuss all matters set forth in CRC 212(e).
Sanctions
The court will impose appropriate sanctions for the failure or refusal to comply with Chapter 7 Rules, orders made by the Court, and time standards or deadlines established by the Court or by the Chapter 7 Rules. Such sanctions may be on a party or, if appropriate, on counsel for such party.
This is not a complete delineation of the Chapter 7 Rules, and adherence only to the above provisions is therefore not a guarantee against the imposition of sanctions under the Trial Court Delay Reduction. Careful reading and compliance with the actual Chapter 7 Rules is absolutely imperative. Please see Local Rules for more information.
